The legal duty behind the CP12, explained plainly
The Gas Safety (Installation and Use) Regulations 1998 place a duty on every landlord in England and Wales to have gas appliances, fittings and flues in a rented property checked for safety once every 12 months by a Gas Safe registered engineer. The record produced from that check is the Landlord Gas Safety Certificate, commonly called a CP12. What the check actually covers
Every gas appliance the landlord owns and supplies to the tenant — boiler, gas fire, gas hob, gas oven, gas water heater — is inspected, along with its flue and ventilation. The engineer checks the appliance is operating safely, burning correctly, correctly ventilated, and that any flue is unobstructed and terminating safely. Gas tightness of the installation pipework is also tested. Tenant-owned appliances, such as a gas cooker a tenant brought with them, fall outside the landlord's legal duty but we will flag anything unsafe regardless.
Who the duty falls on
Any private landlord letting a property with a gas supply, whether that is a single buy-to-let, a portfolio, an HMO or a property managed through a letting agent. The legal responsibility stays with the landlord even where an agent arranges the check on their behalf, so it pays to have one engineer who tracks renewal dates properly rather than assuming the agent has it covered.
When the check is due
Within 12 months of the gas supply being installed, then every 12 months after that — and the window for renewal opens two months before the previous certificate expires, so an annual check can be brought forward without losing time off the original anniversary date. New tenancies also need proof the appliances are safe before the tenant moves in.
Why using a properly registered engineer matters
Only a Gas Safe registered engineer can legally carry out the check and issue a valid CP12. A certificate from an unregistered person, or one that has missed appliances, is worthless if there is an incident, an insurance claim, or a council or Housing Ombudsman inspection. An out-of-date CP12 is one of the easiest ways to lose a rental income
Most landlords do not fall foul of the regulations deliberately — they lose track of a renewal date, assume an agent has it handled, or cannot get access to the property. The consequences land regardless of the reason.
Section 21 eviction blocked
Landlords in England cannot serve a valid Section 21 notice to end an assured shorthold tenancy if the tenant was not given a copy of the current gas safety certificate. An expired or missing CP12 can stop a repossession in its tracks at exactly the point you need it to move.

The Health and Safety Executive enforces these regulations, and breaches can lead to prosecution, unlimited fines and, in the most serious cases involving harm, imprisonment. Local councils also use gas safety compliance as a routine check when licensing HMOs and selective licensing properties.

Landlord insurance policies and buy-to-let mortgage conditions commonly require a valid, in-date gas safety certificate. Should a carbon monoxide incident, fire or gas leak occur without one on file, an insurer can decline the claim entirely, leaving the landlord to cover the loss personally.
Carbon monoxide risk to tenants
The annual check exists because gas appliances can develop faults invisibly — a cracked heat exchanger, a blocked flue, poor ventilation — that produce carbon monoxide with no smell or colour to warn anyone. Skipping the check does not remove the risk, it just removes the warning.
Portfolio drift and missed renewal dates
With several properties on different anniversary dates, it is easy for one certificate to lapse while attention is on the others. A lapsed certificate on even one property in a portfolio carries the same legal and insurance exposure as if none of them were checked.

What gets checked, appliance by appliance
Gas boilers are checked for safe operation, case seals, ventilation and flue condition, along with gas rate and operating pressure where accessible. Gas fires and wall heaters are checked for combustion, ventilation and flue clearance, which matters particularly in older properties with chimney-based flues. Gas hobs and ovens are checked for burner operation, flame picture and, on freestanding cookers, the stability restraint required by the regulations. Any gas water heater is checked in the same way as a boiler.
Where a fault is found, it is classified by severity — from an immediately dangerous appliance that gets capped off on the spot, through 'at risk' faults that need timely correction, to advisory notes that do not affect safety but are worth knowing about. Access issues and how they get resolved
The most common reason a CP12 lapses is not refusal by the landlord but failure to get into the property, particularly with tenants who do not respond to contact. The regulations require landlords to take 'all reasonable steps' to gain access before a deadline is missed, and to keep evidence of those attempts — letters, texts, calls — should it ever be questioned.
In practice this means giving reasonable notice in writing, following up by phone or text, and, where a tenant remains unresponsive, escalating with formal letters that document the attempts. We can time visits around a tenant's working hours, arrange access through an agent holding keys, or attend early morning or evening appointments to reduce the number of failed visits before a deadline.
Combining the CP12 with other work
Because the engineer is already on site with the boiler open and the property accessed, the CP12 check and the annual boiler service are commonly done together in a single visit, which is usually more cost-effective than two separate appointments and easier to arrange with a tenant who has already granted access once.

How long does a CP12 check take?

How long is a Landlord Gas Safety Certificate valid for?
12 months from the date of the check. The regulations allow renewal up to two months before expiry without losing the original anniversary date, which is the window we recommend booking within to avoid a gap in cover.
What happens if a fault is found during the check?
Anything immediately dangerous is made safe or capped off on the spot, as the regulations require. Less urgent faults are explained clearly with a classification of severity, and we can quote a fixed price to fix them, often on the same visit.
Do I have to give my tenant a copy of the certificate?
